Central government employees in Punjab, Haryana and Chandigarh including Army and paramilitary personnel (CRPF, BSF, CISF), nationalized bank employees, Railway staff (Ambala and Firozpur Divisions), Income Tax, Post Office, FCI and other central services ordinarily approach the Central Administrative Tribunal at Chandigarh. High Court writ jurisdiction applies to CAT orders and in matters falling outside CAT jurisdiction.
Common questions
I received a charge sheet from my department. What should I do first?
Do not ignore the charge sheet or let the reply deadline pass. The reply to the charge sheet is the foundation of your entire defence in the disciplinary proceeding. An inadequate or delayed reply significantly limits your options at the appellate and writ stage. Bring the charge sheet and any prior correspondence for review as early as possible.
Can a suspension order be challenged before the enquiry concludes?
A suspension order can be challenged independently of the enquiry. Grounds include excess of jurisdiction, non-compliance with applicable service rules, the order being disproportionate or punitive in nature, or an unreasonable delay by the department in concluding the enquiry. The appropriate forum depends on whether the employee is in Central or State Government service.
I was compulsorily retired under FR 56(j) or an equivalent state rule. Can this be challenged?
Compulsory retirement orders can be challenged on grounds including lack of genuine application of mind, reliance on irrelevant material, non-consideration of the full service record, and the absence of proper subjective satisfaction. The complete service record, the stated basis of the order and the procedure followed must all be examined before advising on the strength of the challenge.
I am a Haryana state employee. Do I go to CAT or the Punjab & Haryana High Court?
Haryana state employees go directly to the Punjab & Haryana High Court by way of writ petition under Article 226. The Central Administrative Tribunal covers only Central Government employees. Haryana Police, HCS officers, Haryana Education Department employees, HSVP, HSSC, Haryana Roadways, Haryana PWD and all other state employees file their service disputes before the High Court, not the CAT.
My promotion was denied despite my seniority. What remedy is available?
Seniority and promotion disputes are decided on applicable service rules, cadre instructions, DPC minutes, reservation roster and precedent. A representation to the competent authority is usually the first step. Central Government employees may approach CAT; Punjab and Haryana state government employees file a writ before the Punjab & Haryana High Court.
Can the department recover money from my pension after retirement?
Recovery from pensionary dues is permitted only in accordance with applicable rules and following due process: notice, opportunity of hearing and a reasoned order. Arbitrary recovery or recovery without following the prescribed procedure can be challenged. The basis, timing and quantum of the recovery all need examination.
I was dismissed from service. Can this be challenged at the High Court?
Dismissal orders can be challenged on grounds including procedural irregularity in the enquiry, violation of natural justice, disproportionality of punishment and absence of a proper finding of guilt. The time within which a challenge must be brought depends on the applicable limitation period. Delay can sometimes be condoned where sufficient cause is shown.
