I received a charge sheet from my department. What do I do first?

Do not ignore the charge sheet or let the reply deadline pass. The reply to the charge sheet is the foundation of your defence in the entire disciplinary proceeding. An inadequate or delayed reply limits your options significantly at later stages: the appellate stage and the writ stage both rely heavily on what is said in the reply. Bring the charge sheet for review as early as possible.

Can my suspension be challenged before the enquiry is over?

Yes. A suspension order can be challenged independently of the enquiry. Grounds include excess of jurisdiction, non-compliance with applicable service rules, the order being disproportionate or punitive in nature, or the department's failure to conclude the enquiry within a reasonable time. The appropriate forum depends on whether the employee is in Central or State Government service.

I was compulsorily retired under FR 56(j). Can this be challenged?

Compulsory retirement orders under FR 56(j) or equivalent state service rules can be challenged on grounds including lack of genuine application of mind, reliance on irrelevant material, non-consideration of the full service record, and the absence of a proper subjective satisfaction on the part of the competent authority. The service record, the basis of the order and the procedure followed must all be examined.

I am a Haryana state employee. Can I approach the Punjab & Haryana High Court directly?

Yes. Haryana state employees file service disputes as writ petitions before the Punjab & Haryana High Court under Article 226. The Central Administrative Tribunal does not cover state government employees. Haryana Police, HCS officers, Haryana Education Department staff, HSVP, HSSC, Haryana Roadways and all Haryana state employees go directly to the High Court.

Can I approach the Punjab & Haryana High Court while my departmental appeal is still pending?

Ordinarily, the departmental remedy must be exhausted before approaching the High Court. However, where the departmental forum is not genuinely independent, where there is unreasonable delay, or where a fundamental procedural violation has occurred, the High Court may exercise writ jurisdiction at an earlier stage. Each case depends on its own facts.

My promotion was denied despite my seniority. What can I do?

Promotion and seniority disputes require review of applicable service rules, cadre instructions, DPC minutes, reservation roster and representations already made. A representation to the competent authority is usually the first step. Central Government employees may then approach CAT; Punjab and Haryana state employees file a writ petition before the Punjab & Haryana High Court.

The department is recovering money from my pension. Is this legal?

Recovery from pensionary dues is permitted only in accordance with applicable service rules and must follow a prescribed procedure: notice, opportunity of hearing and a reasoned order. Arbitrary recovery, recovery without due process or recovery beyond what the rules permit can be challenged. The grounds, amount, basis and procedure followed all need examination.

I was dismissed from service. Can this order be set aside?

Dismissal orders can be challenged on grounds including procedural irregularity in the enquiry, violation of natural justice, disproportionality of punishment and absence of a proper finding of guilt on the charge. The limitation period for bringing a challenge must be respected. Delay can sometimes be condoned where sufficient cause is shown.
