NRI Power of Attorney for Property in India: Safe Drafting and Use

A power of attorney is useful for NRIs, but it should be drafted carefully. A broad document can create future disputes; a vague document can be rejected by courts, revenue authorities or registration offices. The safest approach is usually a purpose-specific power of attorney.

Special POA vs general POA

A special power of attorney authorises a specific act, such as filing a property case, collecting certified copies, appearing before a revenue authority or completing a defined transaction. A general power of attorney gives wider authority and should be used with caution, especially where sale, mortgage or settlement powers are involved.

Execution outside India

A POA signed abroad usually needs proper execution, identity proof, witness details and consular attestation or other applicable authentication. After it reaches India, stamping or adjudication may be required before use. Requirements can vary based on the country, document type and forum where the POA is produced.

Clauses that should be clear

  • Full details of the NRI executant and attorney holder.
  • Exact property description, court case or authority where the POA will be used.
  • Whether the attorney can sign pleadings, affidavits, applications and vakalatnama.
  • Whether sale, lease, compromise or receipt of money is authorised.
  • Duration, revocation and limits on delegation.

What a POA cannot solve

A POA does not remove every need for personal participation. Courts may still require the NRI's own statement, affidavit, evidence or video conference appearance. In criminal matters, a POA holder cannot substitute the accused for all purposes.
