Road Accident Compensation in Punjab and Haryana: MACT Claims Explained

If you or a family member has been injured or killed in a road accident in Punjab or Haryana, you are entitled to claim compensation before a Motor Accidents Claims Tribunal (MACT). This guide explains how the process works, how compensation is calculated, who you file the claim against, and why accepting any insurance company offer without legal advice is usually a serious mistake.

What is the MACT?

The Motor Accidents Claims Tribunal is a statutory tribunal set up under the Motor Vehicles Act to handle road accident compensation claims. In Punjab and Haryana, each district has its own MACT. Claims for accidents occurring within a district are filed at the MACT for that district.

The MACT is not a criminal court. It is a civil forum for deciding compensation. A separate criminal case (FIR for rash and negligent driving) may also run alongside the MACT claim, but they are independent proceedings.

There is no court fee for filing a MACT claim. This means cost of filing is not a barrier to bringing a claim.

Who Can File a MACT Claim?

  • Injured person: If you were injured in a road accident, you can file a claim for your own compensation.
  • Family members of a deceased: If the accident resulted in death, the legal representatives and dependants of the deceased can file a claim for compensation.
  • Parents, spouse, children: These are the primary claimants in a fatal accident claim. The compensation goes to the dependants of the deceased.

The claim is filed against the driver of the offending vehicle, the owner of that vehicle, and the insurance company that issued the vehicle's insurance policy. The insurance company typically takes on the primary liability for paying compensation up to the insured amount.

How is Compensation Calculated?

Compensation in MACT cases is calculated under several heads. The formula is set by Supreme Court judgments and does not vary case to case at the basic level, though the amounts differ based on individual circumstances.

In injury cases, compensation includes:

  • Actual medical expenses incurred and future medical treatment costs.
  • Loss of income during the period of disability or hospitalisation.
  • Future loss of income for permanent disability (calculated as a percentage of disability multiplied by annual income and a multiplier based on age).
  • Pain and suffering and loss of amenities of life (a conventional amount set by courts).
  • Attendant charges and conveyance.

In fatal accident cases, compensation includes:

  • Loss of dependency: the annual income of the deceased (after deducting personal expenses), multiplied by a multiplier based on age at death. This is usually the largest component.
  • Loss of consortium for the spouse.
  • Loss of parental consortium for children.
  • Funeral expenses.
  • A conventional amount for loss of estate.

The income of the deceased, their age, and the number and age of dependants are the critical variables in a fatal accident claim. Higher income and younger age at death generally result in higher compensation. If the deceased was not formally employed but was a homemaker or daily wage earner, income is estimated using minimum wage guidelines or other evidence.

Documents Needed to File a MACT Claim

  • FIR copy from the police station where the accident was reported.
  • Medical records: prescription, hospital bills, discharge summary, doctor's certificates regarding nature of injury and disability.
  • Post-mortem report (in fatal accident cases).
  • Income proof: salary slips, income tax returns, employment letter, bank statements.
  • Insurance details of the offending vehicle (registration number, insurance policy number if available).
  • Death certificate (in fatal cases).
  • Identity and address proof of the claimant.

If some documents are not available at the time of filing, the claim can still be initiated and documents submitted subsequently. The important thing is not to delay filing beyond the limitation period.

Time Limit for Filing: Do Not Delay

MACT claims must be filed within three years of the date of the accident. Filing after three years requires the MACT to condone the delay, which is discretionary and not guaranteed. In practice, claims filed years after the accident face difficulty even if the delay is eventually condoned.

File as soon as the immediate medical emergency is under control and documents can be gathered. There is no advantage to waiting.

Do Not Settle with the Insurance Company Without Legal Advice

Insurance companies often approach accident victims or their families with a settlement offer shortly after the accident. These offers are almost always far below what the MACT would award after a proper hearing. Once you sign a settlement with the insurer and execute a full-and-final discharge, you lose the right to claim further before the MACT.

Before accepting any offer from an insurance company, a lawyer can give you a rough estimate of what the MACT claim is worth based on the income, age and injury or death in your case. This takes a short consultation and the comparison between the insurer's offer and the MACT figure is often stark.

What Happens After the Claim is Filed?

After the claim is filed, the MACT issues notice to the respondents (driver, owner, insurer). The insurer typically contests the claim and files a written statement. Evidence is led by both sides. The tribunal then awards compensation by order. Appeals from MACT orders lie before the Punjab & Haryana High Court.

In cases of serious injury or death, interim compensation can be applied for at an early stage of the MACT proceedings, before the final order is made. This provides some financial relief while the case is pending.
