FIR Quashing After Compromise in Punjab & Haryana High Court
Many criminal cases in Punjab, Haryana and Chandigarh arise from matrimonial, business, property or private disputes that later settle. When the parties have genuinely resolved the matter, the accused may approach the Punjab & Haryana High Court for quashing of the FIR and connected criminal proceedings.
When Compromise-Based Quashing Is Usually Considered
The High Court generally examines whether the offence is private in nature, whether the settlement is voluntary, whether any serious public interest is involved, and whether continuing the prosecution would serve any useful purpose. Matrimonial FIRs, family disputes, business cheating allegations and some property-related complaints are commonly assessed on these lines.
Heinous offences, offences against society, corruption, serious violence and offences with strong public impact require a much stricter assessment. A compromise alone does not automatically end every FIR.
Documents Needed
- FIR copy, sections invoked and police station details.
- Compromise deed signed by all necessary parties.
- Affidavits or identity documents of complainant, victim and accused where required.
- Settlement proof, payment proof or matrimonial settlement terms if applicable.
- Any bail orders, challan status, trial-court orders or connected civil/family court record.
Compromise Verification
The High Court may direct the parties to appear before the trial court or Illaqa Magistrate for verification of the compromise. The trial court records statements and sends a report on whether the settlement appears voluntary and genuine. The High Court then considers the report before passing a final quashing order.
